Faysal Bank Limited (Faysal Bank) MasterCard® SecureCode Terms & Conditions
 
MasterCard SecureCode facility is provided by Faysal Bank Limited (“Faysal Bank”) on its website www.faysalbank.com, exclusively for Faysal Bank credit and/or debit Card customers who are in good standing and are authorized to use the said website and avail the MasterCard SecureCode Facility at the sole discretion of Faysal Bank.
 
MasterCard SecureCode Terms & Conditions (“T&C”) are subject to the Terms & Conditions of Faysal Bank Credit Cards, Debit Cards and Faysal Bank E-solutions.
 
DEFINITIONS
 
1 “Faysal Bank” means Faysal Bank Limited
 
2. “Card” means Faysal Bank Credit and/or Debit Card
 
3. “Customer” means Faysal Bank Credit and/or Debit Card members
 
4. “Site” means Faysal Bank official website.
 
1.      ACCEPTANCE OF TERMS
1(1) MasterCard SecureCode from Faysal Bank Limited (“MasterCard SecureCode”) T&Cs may be updated from time to time without notice to the Customer. The Customer shall review the most current version of the T&Cs at Faysal Bank website. In addition, when using MasterCard SecureCode the Customer shall be subject to any posted guidelines or rules applicable to MasterCard SecureCode from Faysal Bank that may be posted from time to time at Faysal Bank website.
 
1(2) Creation and/or use of MasterCard SecureCode from Faysal Bank shall represent Customer’s acceptance of the T&Cs and the continued use of MasterCard SecureCode after the same has been displayed at the website shall constitute Customer’s agreement to such revised T&Cs and any applicable posted guidelines or rules.
 
1(3) Unless explicitly stated otherwise, any new features that augment enhance or otherwise change MasterCard SecureCode from Faysal Bank shall be subject to these Terms & Conditions.
 
1(4) In case Customer fails to comply with the terms and conditions of Card, Faysal Bank and MasterCard International reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, MasterCard SecureCode from Faysal Bank (or any part thereof) with or without notice.
 
1(5) Upon request, you agree to sign a non-electronic version of these T&Cs.
 
2.      DESCRIPTION OF MASTERCARD SECURECODE FROM Faysal Bank
2(1) MasterCard SecureCode from Faysal Bank provides the Customer with an additional layer of security in online transactions by reducing the chances of fraud for those transactions. Registering for MasterCard SecureCode involves providing personal information, which is then used to confirm Customer’s identity in connection with future online transactions, as discussed in more detail in Clause 5 below. MasterCard SecureCode from Faysal Bank also may be used by the Customer for record keeping and reporting purposes, as well as to help resolve any transaction disputes. Customer’s Registration Data, as defined in Clause 3(b), and other personal information shall not be shared with the merchant, as discussed in more detail in Clause 6 below.
 
2(2) The MasterCard SecureCode from Faysal Bank shall only be used by the Customer when shopping at participating online merchants.
 
3.      THE CUSTOMER’S REGISTRATION OBLIGATIONS
3(1) By signing up for MasterCard SecureCode from Faysal Bank, the Customer authorizes Faysal Bank to retain certain information about the Customer and the Customer’s Card. The Customer authorizes Faysal Bank to obtain from certain third parties selected by Faysal Bank, including consumer credit bureaus and other consumer reporting agencies, information about the Customer, the Customer’s Card, to use in connection with MasterCard SecureCode from Faysal Bank. The Customer authorizes Faysal Bank to use and retain this information in accordance with Faysal Bank Privacy Policy (see Clause 6 below). The Customer’s information shall be associated with a unique identifier for the Customer (i.e. the Customer’s "SecureCode").
 
 
3(2) The Customer agrees to provide true, accurate, current and complete information about the Customer as prompted by MasterCard SecureCode Faysal Bank’s registration form ("Registration Data"). If the Customer provides any Registration Data that is untrue, inaccurate, not current or incomplete, or if Faysal Bank has reasonable grounds to suspect that the Customer’s Registration Data is untrue, inaccurate, not current or incomplete, Faysal Bank shall have the right to suspend, terminate, or refuse the Customer’s current or future use of MasterCard SecureCode from Faysal Bank.
 
4.      REGISTRATION
4(1) In order to use MasterCard SecureCode from Faysal Bank, the Customer shall provide certain information to Faysal Bank that allows Faysal Bank to validate the Customer’s identity and verify that the Customer is the owner of, or an authorized user of the specified Card. The information that the Customer provides shall be validated against the customer’s record maintained with Faysal Bank. Here the customer information required will be Card number, Card Expiry Date, Computerized NIC, CVC2 value printed on the back of the Card.
 
4(2) If the Customer is unable to provide adequate information to validate the Customer’s identity, Faysal Bank shall have the right to not allow the Customer to register for MasterCard SecureCode from Faysal Bank. The Customer shall warrant that the information is correct and that the Customer has the legal right to use all of the Cards that the Customer shall register for MasterCard SecureCode from Faysal Bank.
 
4(3) In order to use MasterCard SecureCode from Faysal Bank the Customer shall have the ability to access the World Wide Web and must pay any service fees associated with such access. In addition, the Customer must have the equipment necessary to make such a connection to the World Wide Web, including a computer and modem or other access device. 
 
4(4)In the event the Customer has a question regarding the MasterCard SecureCode from Faysal Bank, registration process or a transaction using MasterCard SecureCode from Faysal Bank, the Customer shall direct that question to our Customer Interaction Center at the number printed on the back of the Card. The same is also covered in FAQ’s section.
 
5.      AUTHENTICATION
5(1) If the Customer is unable to provide SecureCode when asked before payment for the transaction when engaging in an online transaction for which MasterCard SecureCode from Faysal Bank is used, or if the authentication through MasterCard SecureCode from Faysal Bank otherwise fails, the card shall not be accepted for payment of that transaction.
 
5(2) By registering in MasterCard SecureCode from Faysal Bank, the Customer shall assent to the use of MasterCard SecureCode from Faysal Bank to evidence his/her identity, including for purposes of authorization of transactions authorized in advance to recur at substantially regular intervals.
 
6.      CUSTOMER INFORMATION
 
6(1) The Customer acknowledges and agree that Faysal Bank shall keep his/her Registration Data and also may disclose his/her Registration Data if required, in the good faith that such preservation or disclosure is permitted, or as reasonably necessary to (i) comply with legal process or (ii) enforce these T&Cs.
 
7.      PRIVACY POLICY
 
7(1) The Customer shall read and accept all Privacy Policy at http://faysalbank.com conditions in order to register for and use MasterCard SecureCode from Faysal Bank.
 
8.       CARDHOLDER SECURECODE AND SECURITY
8(1) The Customer shall be solely responsible for maintaining the confidentiality of his/her SecureCode, Registration Data and other verification information supplied to and established by him/her with MasterCard SecureCode from Faysal Bank and all activities that occur using the SecureCode. The Customer shall agree not to transfer or sell his/her use of, or access to MasterCard SecureCode from Faysal Bank to any third party. The Customer shall agree to immediately notify MasterCard SecureCode from Faysal Bank by contacting us as given under Faysal Bank Terms & Conditions of Credit Card and/or Debit Card for a lost or stolen card or any unauthorized use of his/her password or other verification information, or any other breach of security. The Customer also acknowledges and agrees that, except as otherwise provided by Applicable Law or in Faysal Bank Cards Terms & Conditions, Faysal Bank shall not be liable for any loss or damage arising from his/her failure to comply with these T&Cs.
 
9.      CUSTOMER’S CONDUCT
 Customer agrees not to:
 
9(1) Impersonate any person or entity using MasterCard SecureCode from Faysal Bank.
 
9(2) Upload, post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment used by MasterCard SecureCode from Faysal Bank.
 
9(3) Spam or flood the Website or service.
 
9(4) Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the MasterCard SecureCode website or service or the software used in connection with MasterCard SecureCode from Faysal Bank.
 
9(5) Remove any copyright, trademark, or other proprietary rights / notices contained in MasterCard SecureCode from Faysal Bank.
 
9(6) “Frame" or "mirror" any part of the MasterCard SecureCode from Faysal Bank Website or service without the prior written authorization of Faysal Bank.
 
9(7) Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, data mine, or in any way reproduce or circumvent the navigational structure or presentation of the MasterCard SecureCode from Faysal Bank Website or service or its contents.
 
9(8) Otherwise interfere with, or disrupt, MasterCard SecureCode from Faysal Bank or servers or networks connected to MasterCard SecureCode from Faysal Bank, or violate these T&Cs or any requirements, procedures, policies or regulations of MasterCard SecureCode from Faysal Bank or of any networks connected to MasterCard SecureCode from Faysal Bank.
 
9(9) intentionally or unintentionally violate any applicable local, state, national or international statute, regulation, regulatory guideline or judicial or administrative interpretation.
10.  CUSTOMER’S RESPONSIBILITIES
The Customer acknowledges and agrees that he/she has the following responsibilities:
10(1) To verify that the information entered on all merchant order forms is accurate.
 
10(2) To verify that the information displayed in the MasterCard SecureCode transaction screen is correct for each purchase.
 
10(3) To make full and timely payments for any purchases made involving the MasterCard SecureCode or this website.
 
10(4) To be fully responsible for all transactions or other activities that occur or are undertaken under Customer’s username and password.
 
10(5) To safeguard the confidentiality of Customer’s user name and password for the MasterCard SecureCode and/or this website.
 
10(6) To immediately report to Faysal Bank if the Customer’s username or password for the MasterCard SecureCode or this website are stolen or compromised.
 
10(7) To refrain from any resale of the MasterCard SecureCode or this website or any part thereof, from making a derivative of the MasterCard SecureCode or this website or any part thereof, from collecting or using any information provided by other users without their express written consent, or from otherwise engaging in any form of data mining or data extraction with respect to any data accessible through the MasterCard SecureCode or this website.
 
10(8) To not use the MasterCard SecureCode or this website in a manner that would: (a) infringe any third party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy; (b) be fraudulent or involve the sale of counterfeit or stolen items; (c) violate any law, statute, ordinance, or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); (d) be false, misleading, or inaccurate; (e) create liability for MasterCard or its Suppliers or cause MasterCard or its Suppliers to lose (in whole or in part) the services of our third party providers; (f) be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing; or (g) be obscene, pornographic, or contain child pornography.
 
10(9)To refrain from gaining access or attempting to gain access to any information, software or data on MasterCard's or its Suppliers' servers or otherwise within their control which is encrypted, protected by security procedures or devices or (except for Customer’s personal information) otherwise not generally made available to the public.
 
10(10) To refrain from using the MasterCard SecureCode or this website in a manner which will or might interfere with the full use and enjoyment by other users of the MasterCard SecureCode or this website.
 
10(11)To defend, indemnify, and hold harmless MasterCard and certain others from all third party claims according to the conditions set forth below.
 
11.  LIABILITY
11(1) The Customer agrees that Faysal Bank and MasterCard International shall not be liable to the Customer or to any third party for any modification, suspension or discontinuance of MasterCard SecureCode from Faysal Bank, unless the loss is caused due to:
 
(a) Negligence or intentional misconduct by Faysal Bank, its employees or agents;
 
(b) An attack by others on the systems Faysal Bank uses to provide MasterCard SecureCode from Faysal Bank
 
Under no circumstances shall Faysal Bank be liable for consequential, incidental, special or indirect losses or other damages, such as any damage to Customer’s computer or telephone service resulting from Customer’s use of MasterCard SecureCode from Faysal Bank.
 
11(2) Faysal Bank shall not be responsible for, and shall not be liable for, any damages to, or any viruses which may affect, Customer’s computer equipment or other property on account of his/her access to, use of, or downloading from, this Website.
 
12.  TERMINATION
12(1) The Customer shall deactivate his/her MasterCard SecureCode from Faysal Bank if the Customer wishes to end his/her access to online retail through MasterCard SecureCode from Faysal Bank. However, any purchases that the Customer had made using MasterCard SecureCode from Faysal Bank prior to deactivation will not be affected.
 
 
12(2) Faysal Bank shall temporarily or permanently deactivate Customer’s ability to use MasterCard SecureCode from Faysal Bank and terminate his/her relationship with Faysal Bank at any time at the discretion of Faysal Bank without assigning any reason.
 
13.  DEALINGS WITH MERCHANTS
 
13(1) Customer’s correspondence or business dealings with, or participation in promotions of, online retail through MasterCard SecureCode from Faysal Bank, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between the Customer and such merchant. The Customer agrees that, except as otherwise provided by Applicable Law or in Faysal Bank Credit Card and/or Debit Card Terms & Conditions, Faysal Bank, shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. The Customer understands that use of MasterCard SecureCode from Faysal Bank does not, in any way, indicate that Faysal Bank recommend or endorse any merchant, regardless of whether the merchant participates in MasterCard SecureCode from Faysal Bank. For example; Faysal Bank does not verify the identity of the merchant or the quality of the merchant's goods or services.
 
13(2) The MasterCard SecureCode from Faysal Bank service shall only be used when shopping at participating online merchants.
 
14.  NOTICE
 
14(1) Notices to the Customer shall be made via e-mail or regular mail to any address in Customer’s Registration Data or other information that the Customer has provided to Faysal Bank in connection with any of his/her accounts with Faysal Bank, or Customer’s Cards issued or otherwise provided by Faysal Bank. Delivery of mail to such given address shall fulfill Faysal Bank obligation to serve notice upon the Customer. Faysal Bank shall not be responsible for failure of delivery due to inaccurate data provided by the Customer.
 
15.  AGE AND RESPONSIBILITY
 
15(1) The Customer shall be of specific age mentioned in the Faysal Bank Credit Card and/or Debit Card Terms & Conditions to use MasterCard SecureCode from Faysal Bank and to create binding legal obligations for any liability he/she may incur as a result of the use of MasterCard SecureCode from Faysal Bank. Except as otherwise provided by the Applicable Law or in Faysal Bank Credit Card and/or Debit Card Terms & Conditions, the Customer understands that he/she is financially responsible for all uses of MasterCard SecureCode from Faysal Bank  by himself/herself and those authorized by the Customer to use his/her Registration Data, his/her password or other verification information.
 
16.  PROPERTY RIGHTS
16(1) This website is owned by Faysal Bank. Any materials/authorization provided to you are merely licensed to you subject to use as per the specified T&Cs.
 
16(2) The Courts in Karachi shall have exclusive jurisdiction as regards any claims or matters arising out of this Facility and/or this Site and all provisions thereof shall be governed by the laws of Islamic Republic of Pakistan.
 
17.  INDEMNIFICATION
17(1) The Customer agrees to defend, indemnify, and hold harmless Faysal Bank their licensees, successors, and assigns, affiliated merchants, content providers, technology and service providers, or this website providers, advertisers and sponsors, the parent, affiliated and subsidiary companies of each of them and the officers, directors, employees, and agents of each of them from and against any and all third party claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses, including reasonable attorneys' fees, arising out of or related to any breach or alleged breach by the Customer of these T&C’s or any use of MasterCard SecureCode by the Customer or under Customer’s control.
